Principal Statement of Terms and Conditions of Employment
 (aka Section one Statement)
 
As you may be aware from previous Information Updates, the government commissioned an Independent Review of Employment Practices by Matthew Taylor which came up with a raft of recommendations (The Good Work Plan). The plan is focused on improving communication and certainty in the working relationship, and the proposal is that the written statement of employment must include information about employees’ rights.

So, what’s changing?
Currently:
  • A Principal Statement must be issued to an employee within 2 months of commencing employment.

NEW:
  • With effect from 6th April 2020, a Principal Statement must be issued to a Worker (not just an employee) on, or before, the first day of employment.

Definition of a worker is someone employed on:
a) a contract of employment, or
b) any other contract, whether express or implied and (if it is express) whether oral or in writing, whereby the individual undertakes to do or perform personally any work or services for another party to the contract whose status is not by virtue of the contract that of a client or customer of any profession or business undertaking carried on by the individual.

The Principal Statement will need to include the following:
 
 
You do not need to issue new Principal Statements to all your existing employees, but the new Principal Statement will need to be issued to:
  1. any employee / worker who has not been issued with a Principal Statement; and
  2. any employee / worker who is employed after 6th April 2020 (but remember it must be issued on, or before, the first day of employment).
